Once we have received your release form you are free to submit images in future without needing to send another form. We will make a note of the date of new submissions on a space provided on the original form and you can simply mark a note with the Images, either in email or by post with a CD. Your short notice with such subsequent contributions should read as follows:

"These images are submitted according to the original General Photographic Worldwide Release Form dated DD/MM/YY"

(email submissions are not possible at this time - they will be soon, in any event a Hard Copy of the form is required in ALLl cases. If you do NOT provide a signed Hard Copy of the form we won't consider your images)

What Does the Release Wording Mean?

If you have been taking photographs for some time it is likely that you have come across a release form before. Permission for Properties and Models present in photographs is often granted in a similar release form, you can see a reference to that in our Form's wording also.

To make it easy to understand how this form protects you, the contributor and also NE Photo we shall take a look at the various points that are made in the wording. If you have downloaded and printed the form out, have it handy in order to make understanding it easier while you read this breakdown:

The form's title is fairly obvious, but the first sentence is long and seems complicated. What it basically means is that you are saying that you own the copyright on the images you want to submit so that NE Photo can print/reproduce them in a variety of contexts within reason.

The term 'unexclusive' relates to the fact that you are not granting us 'exclusive' use, but that you will also be able to grant permission to other people to use the image and of course to continue using the image yourself. You do not lose your ownership of copyright by signing this form, that remains with you.

Unfortunately by submitting photos to us you DO lose your ability to grant any OTHER people 'exclusive rights'. This is because in order to grant such permission you would have to exclude our right to use the images, which is not possible within the terms of this release. If you find yourself in a position where you WANT to grant exclusive rights to someone for a particular image you have submitted, then you must contact us and discuss whether it is practical for that to happen. This may not be possible and we cannot promise to be able to help, but we wouldn't want to hinder you making successful use of an image if we could help. When it comes down to it, people who want to buy exclusive rights from you, for whatever purpose, would likely require that no previous publication has been made, but it is basically down to what they are willing to accept much more than it is within our power to grant such things.

The bit about marketing materials within that section is basically to allow images that would be in the journal to be used in any posters or flyers or on this site.

The note on material size is fairly clear, but the extra note about images being no more than 50% of an item (such as a poster) is to protect you. This is basically a requirement not to print off a bunch of individual posters which are essentially just a large print of your photo. any photographer wishing to sell such prints would clearly be at a disadvantage if we were to do that. We would like to see photographers succeed in selling such prints, and naturally we do not want to harm any prospects you would have of doign so.

The note about cropping, toning and editing images is to enable your photos to look best in the printing and format of the journal. Obviously this is to your advantage as it aims to provide the best showcase of your work. Also, Black and White images dont print so well in the colour print process we use, adding a slight blue or sepia tone will add colour to the print process which will, again, look more pleasing in the Journal. Overall, we would rather make an image look better by applying a small amount of editing than flatly rejecting it as being unsuitable.

As stated earlier, Property and Model releases are basic documents in the industry, and it would be impossible for the Journal to take responsibility for the variety of locations and people within its pages. Therefore this note is to ensure that photographers submitting images are aware that it is their obligation to acquire these documents. This is a good working practice and we encourage its application in order to remain professional.

The note about 'territories' and 'perpetuity' is basically to allow us to distribute the Journal all over the world without any hitches and to keep printing back issues or perhaps re-use your images in a compendium for any time in the future. You have to agree to this in order to submit, and you are bound by that agreement.

The bit about money is basically to protect yourself and us. You are accepting that you won't demand any money so long as we stick to the agreement. This is good for both of us, because we dont want to break the agreement ;)

An additional advantage for having this money statement set in the wording is that it protects you from any potential tax or earnings complications. This is effectively a statement of zero pay, it is proof that you haven't been 'earning on the side'. If you find this useful you should keep a copy to present to either your employer, the Taxman, benefits officals or anyone else who might query your having your work and name published.

It is the intention of the Journal to keep the PDF file updated online and also to archive copies of any wordings prior to amendments, but if you want to be given a copy of your OWN signed statement we could provide it for an admin fee of £5. It's therefore, in any event it would be a good idea for you to keep your own copy of the wording as you signed it before sending it in to us.
